Auto-enrolment has been mandatory for UK employers since 2012, yet The Pensions Regulator (TPR) still issues thousands of compliance notices every year. Most of them trace back to a small set of recurring, avoidable errors.
Missing the re-enrolment date
Every three years, employers must re-assess and re-enrol eligible staff who previously opted out. It's easy to miss because it isn't tied to a payroll event — it's tied to your original staging date. Put it on a calendar the moment your scheme starts, not when TPR reminds you.
Assessing age and earnings incorrectly
Eligibility depends on age (22 to State Pension age) and qualifying earnings (currently above £10,000 a year, pro-rated per pay period). Doing this assessment manually in a spreadsheet is where most errors creep in, especially for employees with variable hours or multiple pay elements.
Treating opt-outs as permanent
An opt-out only lasts until the next re-enrolment date, or until the employee asks to re-join sooner. Some payroll processes mistakenly treat an opt-out as a permanent flag, silently excluding staff who should have been re-assessed.
Late or incorrect declaration of compliance
The declaration of compliance to TPR is due within five months of your staging or re-enrolment date. Missing it is one of the most common reasons employers receive a fixed penalty notice, even when the underlying scheme itself was set up correctly.
